Ken Lay Waits for Trial Decisions

Lay won't hear U.S. District Judge Sim Lake's decision on the bank chargesuntil the jury returns with a verdict on the original Enron fraud andconspiracy charges.
Lay has admitted in his testimony that he did not follow provisions of loandocuments that prohibited him from using bank loans to buy stock on margin.
Prosecutor Sean Berkowitz said Lay got caught with his hand in the cookiejar.
Defense attorney Mac Secrest noted that bankers never complained.
The jury in the fraud and conspiracy case will spend a fifth day consideringsix counts against Lay and 28 counts against Jeff Skilling.
