Eminent Domain Amendment

Governor Rick Perry says he wants to protect landowners, by strengthening state law to restrict the state's powers of eminent domain. Jim Bell explains.

Texas already has a law, passed four years ago, that prohibits using eminent domain to take private land for economic development or private purposes. It can only be used for public projects.  That came after a controversial U.S. Supreme Court ruling that said that practice is legal.

Perry says he wants to bolster the law by putting it in the state constitution, and he joined lawmakers and property rights advocates in calling on the legislature to pass the amendment.

Perry is bracing for next year's Republican primary, because his number one Republican rival, Senator Kay Bailey Hutchison, has already said that protecting private property rights will be one of her issues.
